It clearly says that this is against the Law. Bribery is the giving or offering of a Bribe. Bribery of Public Officials is penalized under Articles 210 to 212 of the Revised Penal Code. There are also other Laws that penalized corrupt acts and practices and prohibit the giving of gifts to some public officials.
The Anti-Graft and Corruption Practices Act or Rep. Act No. 3019 enumerates certain actions and decisions of public officer that may lead to their downfall. Like requesting or receiving any gift, presents, share, percentage, benefits for own self, a transaction between the Government and a private Entity or Corporation.
Securing a Government Permit or License and even Entering on behalf of the Government into any contract or Projects which is actually Unethical under Rep. Act 6713 which is The Code of Conduct and Ethical Standards for Public Officials and Employees prohibits public officials and employees from soliciting, accepting directly or indirectly from any person whether that person is known or ordinary person.
There are three kinds of Bribery first is Direct Bribery; committed by a Public Officer who accepts an offer, promise or receive gifts. Indirect Bribery; committed by a public officer who accepts a gift offered to him by a reason of his/her office.
And Qualified Bribery, who refrains from arresting or persecuting an offender who has committed a crime which he/she was offered a promise and a present moreover just a note that these 3 kinds of Bribery have different penalty that law determines.
Now we go to No Issuance of Receipt. Bureau of Internal Revenue (BIR) warned Professionals and Business Establishments that do not issue official receipts or an O.R will be made criminally liable once caught for all persons subject to internal revenue tax are required to issue duly registered receipts amounting to 25 pesos or more from his/her acquired service or products.
Under Presidential Decree No. 1254 Failure or Refusal to issue Receipt shall be penalized for the first offense is a fine not more than two hundred pesos and imprisonment of not more than 6 Months. 2nd Offense is a fine of not less than two hundred pesos and not more than php 3,000 and imprisonment of less than 6Months but not more than 3 years.
And Subsequent Offense not less than 3 years but not more than 6 years with a fine of less than 3K but not more than 6K. Running away from all of this will eventually haunt you down.
