Pagsasara sa Camp 7 batching plant, inirekomenda ng CEPMO

Inirekomenda ng City Environment and Parks Management Office (CEPMO) ang pagsara ng operasyon at tuluyang relokasyon ng kontrobersiyal na Camp 7 cement batching plant dahil sa mga paglabag sa Environment Code at ibang may kaugnayan na panukala sa lungsod, rules and regulations na namamahala sa mga kritikal na proyekto sa kapaligiran sa iba’t ibang bahagi ng lungsod.
Nakasaad sa sulat ni City Environment and Parks Management Officer Cordillera Lacsamana kay Mayor Mauricio Domogan na ang operator ng concrete batching plant na makikita sa loob ng residential area ng Barangay Camp 7 ay kailangang ilipat upang sumunod sa kaugnay na mga probisyon ng umiiral na batas.
Paliwanag niya na ang operator ng batching plant ay lumabag sa Article XVI, Section 95 ng Ordinance No. 18, series of 2016 na nagbabawal ng “acts of building, erecting, constructing, installing, or implanting any new source, operate, modify or rebuild an existing source, or by any means cause or undertake any activity which would result in ambient noise level higher than the standard prescribed by law”.
Dagdag pa niya, hindi rin maaari na sinumang tao ay maglalabas o maging dahilan upang maglabas ng sobrang ingay o tunog na mas mataas sa volume intensity o kalidad na iniutos ng national standards para sa tolerable noise.
Inihayag ni Lacsamana na ang operator ng Camp 7 concrete batching plant ay lumabag din sa Article XVII, Section 97 ng city’s Environment code na “prohibits any person, natural or juridical, from mixing cement or job mix along roadsides and in large constructions within the city and causing, permitting, suffering, or allowing the emission of particulate matter from any source whatsoever, including but not limited to vehicular movement, exportation of materials, construction, alteration, demolition or wrecking, reclamation or industry-related activities such as loading, sorting or handling without giving reasonable precautions to prevent the occurrence of such condition”.
Kasama rin sa nilabag ng operator ng cement batching plant ay ang “causing or permitting the discharge of visible fugitive dust emissions beyond the boundary line of the property from which the emission originates”.
Ayon pa sa ulat ng CEPMO, ang operator ay lumabag din sa Article 22, Section 136 ng parehong alituntunin kung saan “all industrial wastes, including waste water, shall be collected, stored or disposed of accordingly to prevent health hazards, nuisances and water pollution and preservation of natural drainage ways and strict enforcement of easement as provided under the National Building code shall strictly be followed”.
Nabanggit din sa ulat ang Article 24, Section 128 ng parehong alituntunin na idinagdag ay anumang material na solid, liquid o semi-solid, naglalaman ng gas o anumang paraan na resulta ng industrial, commercial, mining o agricultural operations, o aktibidad mula sa komunidad o sambahayan ay hindi dapat itinatapon nang direkta sa ilog, bukal, kanal o waterways.
Ito rin ay ipinahayag na patakaran ng lokal na pamahalaan upang ipagbawal ang mga job mix activities sa mga pangunahing kalsada at lahat ng mga kalsada ng barangay sa siyudad at ang paglalagay ng mga cement batching plants sa nasabing mga lugar. BAGUIO PIO / ABN
