Fairview Bocap files complaint vs appointed kagawad for misrepresentation

The punong barangay of Barangay Fairview, Baguio filed a complaint against one of her barangay kagawads for misrepresenting himself to impel police authorities to release a violator of the enhanced community quarantine.

In a 2-page affidavit complaint filed last May 28 at the sangguniang panglusod of
Baguio and the Office of the City Prosecutor, Fairview Punong Barangay Justina P. Andaya stated that she received a phone call from the police looking for Richard S.
Jimenez, an appointed barangay kagawad of Fairview, but who claimed that he was the punong barangay.

She told the Baguio City Police Office that she is in fact the punong barangay, not Jimenez.

Based on the joint affidavit of Police Master Sergeant Patrick L. Lamog, Police Staff
Sgt. Dennis G. Geron, and PSSg. Romana C. Ablao, the BCPO operatives on duty tasked to watch and interview ECQ violators at the Athletic Bowl, a man identified as Jimenez approached them on April 23 and asked to talk with one Rowena Arellano, the ECQ violator and a Fairview resident.

Jimenez asked Lamog if Arellano could be release as she was not feeling well and had to buy medicine.

When asked, Jimenez answered that he is the Fairview punong barangay. Lamog told Jimenez that Arellano cannot be released because of her violations, and for Jimenez to talk with the Station 7 commander because Lamog is not the proper person to decide on the request.

Lamog said Jimenez went to talk with the guard on duty, Renmark Corpuz who informed them that the security manager Rosemarie Munoz wanted to talk to Arellano. Geron allowed Corpuz to escort Arellano to the Athletic Bowl gate, on condition that she will be brought back after the conversation.

However, Jimenez and the security manager suddenly let Arellano board a car. Lamog and Geron tried to stop the car but it sped away. Arellano was later arrested again at her residence.

The police officers later called the cell phone number Jimenez gave to them, and there they learned from Andaya that she is the punong barangay and Jimenez is an appointed kagawad of Fairview.

Andaya asked the Prosecutor’s Office to institute charges against Jimenez for dishonesty, oppression, misconduct in office, dereliction of duty, and abuse of authority in violation of Republic Act 7160 otherwise known as the Local Government Code, commission of unethical conduct in violation of Republic Act 6713 otherwise known as the Code of Conduct and Ethical Standards for Public Officials and Employees, and gross misconduct, oppression, conduct prejudicial to the best interest of the service and discrimination in violation of Section 22(c), (f), and (t) Rule 14 of the Omnibus Rules Implementing Book 5 of Executive Order 292 or the Administrative Code of 1987.
